1. Scope

For all deliveries of

to consumers (§ 13 BGB), these General Terms and Conditions (GTC) apply.
A consumer is any natural person who enters into a legal transaction for a purpose that is predominantly neither commercial nor self-employed.

2. Contractors

The purchase contract is concluded with

3. Offer and conclusion of contract

By clicking the button "Buy now" you place a binding order of the goods contained in the order basket. Your order constitutes an offer to conclude a purchase contract with us (weidenthaler). The confirmation of receipt of your order by us will be sent by automated e-mail immediately after sending the order. This order confirmation does not represent an acceptance of your offer, but only informs you that we have received your order. A purchase contract is only concluded when we ship the ordered product to you.

When ordering through our store, the ordering process includes a total of two steps. In the first step you select the desired goods and put them in the shopping cart. In the second step you go "to checkout". There you choose how you want to pay and how you want to receive the goods. If you want to make a comment about your order, you have the opportunity to do so in this section. Then log into your customer account (if you have not already done so) or open a new account, or enter your customer data including billing address and possibly different delivery address for a "guest order" without opening an account. After you have declared that you have taken note of our terms and conditions and your right of withdrawal, you have the opportunity to review all information (e.g. name, address, payment method, ordered items) and correct them if necessary before you send your order to us by clicking "Buy now". Depending on the payment option you choose, you will now either be redirected to our payment service providers (PayPal or Amazon Payments) where you will enter your payment details and then be redirected back to our site to receive the order confirmation/summary, or if you purchased in advance you will receive the order confirmation/summary directly.

4. Right of withdrawal

4.1 Consumers have a fourteen-day right of withdrawal.

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.
To exercise the right of withdrawal, you must inform us (Weidenthaler-Musiolik, Kettelerstr.19, 76768 Berg - Germany, Tel.: +49 7273 4795, Email: info@weidenthaler.shop) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You may use the attached model withdrawal form, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.
You will have to bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

5. Prices, delivery conditions and shipping costs

5.1 The prices stated on the product pages include the statutory value added tax and other price components.
5.2 We deliver to Germany, Denmark, Finland, France, Italy, Liechtenstein, Luxembourg, Malta, Monaco, Netherlands, Norway, Austria, Portugal, Sweden, Switzerland and Spain. For deliveries outside Germany, additional costs, e.g. customs duties, may arise. Delivery times are those stated with the offer, which only apply to deliveries to Germany. For deliveries to other countries, the duration may vary.
5.3 The mode of shipment, the shipping route and the company commissioned with the shipment can be determined by us (weidenthaler) at our own discretion.
5.4 In addition to the stated prices, we charge the shipping costs incurred for the delivery, within Germany a flat rate of 4,- EUR per order, outside Germany to all other countries supplied by us a flat rate of 5,-€ per order.
From 150,-€ order value, we deliver free of shipping costs.


6. Payment

6.1 Payment shall be made in advance (bank transfer), direct debit, credit card (Visa/Mastercard,etc.), PayPal, Amazon Payments or by cash payment upon collection.
6.2 If you choose the payment method prepayment (bank transfer), we will give you our bank details in the order confirmation and deliver the order after receipt of payment.

7. Liability for defects (warranty)

7.1 Liability for defects (warranty) shall be governed by the statutory provisions.

8. Storage of the contract text

We store the contract text of your order. You can print this before sending your order to us by clicking on "Print" in the last step of the order process. We will also send you an order confirmation as well as an order confirmation with all order data to the email address you have provided.

9. Privacy

More detailed information about the collection, processing and protection of your data in accordance with the GDPR (General Data Protection Regulation) can be found in our Privacy Policy .

When you visit our website, usage data (e.g. web pages visited, access times) and meta/communication data (e.g. IP addresses, browser used) are stored in so-called server log files. Likewise, content data (e.g. videos, text entries), inventory data (e.g. names and addresses) and contact data (e.g. e-mail addresses, telephone numbers) are collected and processed.
This data is collected and processed by us only to the extent necessary in accordance with the statutory regulations under the GDPR for the purpose of operating our online offering and optimizing the content (e.g. through anonymized, statistical evaluations and cookies), but also to implement security measures. Likewise, we use this data to communicate with you, e.g. to answer your contact requests or to inform you. In doing so, we ensure an adequate level of protection of this data in accordance with Article 32 GDPR.

Your data will only be passed on to third parties (e.g. to the shipping company commissioned with the delivery or to a payment service provider) on a legal basis, e.g. if this is required in accordance with Article 6 (1) lit. b GDPR is necessary for the performance of the contract, you have consented, there is a legal obligation to do so or if we have a legitimate interest in doing so (e.g. commissioning web hosts, protecting our rights, etc.).
If we process data or have data processed in a third country, we only do so if it is done to fulfill our (pre)contractual obligations, with your consent, due to a legal obligation or on the basis of our legitimate interests. Subject to legal or contractual permissions, this only occurs if the requirements of Art. 44 et seq. GDPR are met, e.g., special guarantees exist, such as the officially recognized determination of a level of data protection corresponding to the EU or compliance with officially recognized special contractual obligations (so-called "standard contractual clauses").

The data processed by us will be deleted or restricted in its processing in accordance with Articles 17 and 18 GDPR as soon as it is no longer required for its intended purpose and the deletion does not conflict with any statutory retention obligations. According to legal requirements in Germany, the storage takes place in particular for 10 years in accordance with §§ 147 para. 1 AO, 257 Abs. 1 Nr. 1 und 4, Abs. 4 HGB (books, records, management reports, accounting vouchers, commercial books, documents relevant for taxation, etc.) and 6 years according to § 257 para. 1 Nr. 2 und 3, Abs. 4 HGB (Commercial Letters).

Your rights

- Pursuant to Article 15 of the GDPR, you have the right, upon request and free of charge, to obtain information and further details about the personal data we have processed about you and to receive a copy of this data.
- In addition, pursuant to Article 16 GDPR, you have the right to request the correction or completion of incorrect or incomplete data.
- In accordance with Article 17 of the GDPR, you have the right to demand that the data in question be deleted without delay, or alternatively, in accordance with Article 18 of the GDPR, to demand restriction of the processing of the data.
- You have the right to request and receive the data concerning you that you have provided to us, in accordance with Article 20 of the GDPR, and to request that it be transferred to other data controllers.
- In accordance with Art. 77 GDPR, you have the right to file a complaint with the competent supervisory authority.

Your right of revocation

- You have the right to withdraw consent granted pursuant to. Art. 7 Abs. 3 GDPR with effect for the future

Your right of objection

- You may object to the future processing of data concerning you in accordance with Art. 21 DSGVO at any time. The objection can be made in particular against the processing for purposes of direct advertising.

Information about the legal basis of our data processing pursuant to Article 13 GDPR

Unless the legal basis is stated in the privacy policy, the following applies:
The legal basis for obtaining consent is Art. 6 para. 1 lit. a and Art. 7 GDPR, the legal basis for processing for the fulfillment of our services and implementation of contractual measures as well as answering inquiries is Art. 6 para. 1 lit. b GDPR, the legal basis for processing to fulfill our legal obligations is Art. 6 para. 1 lit. c GDPR, and the legal basis for processing to protect our legitimate interests is Art. 6 para. 1 lit. f GDPR. In the event that vital interests of you or another natural person require the processing of personal data, Art. 6 para. 1 lit. d GDPR as the legal basis.
If we commission third parties with the processing of data (e.g. web hosters), this is done on the basis of a "contract processing agreement" in accordance with Article 28 GDPR.

10. Retention of title

Until full payment, the goods remain our property.
